BOOKING CONFIRMATION - You, the ‘Hirer’ upon payment and receipt of the ‘Rental Fee’ (in full or part thereof) are securing the ‘Event date’ for the ‘Booking Period’ specified on the ‘Invoice’. Payment must be made via internet transfer. In processing the ‘Rental Fee’ payment the ‘Hirer’ agrees to these ‘Terms and Conditions’ in full.
GST - All amounts include GST
INCLUSIONS - The Rental Fee payment includes all cleaning and rubbish removal to a fair & reasonable standard. For the sake of clarity any additional cleaning time taken over 1 1/2 hours will incur additional cleaning costs at $100 p/h and be invoiced and deducted from the “BOND”
BOND – The ‘Hirer agrees to pay a $500 Bond as security to cover any breakages, damage to property or additional cleaning services or the like. Should the damages exceed the Bond provided the Hirer will be liable for all additional costs.
SERVICES - Additional services agreed between the parties such as Security and/or Staff expense will be invoiced and paid 7 days prior to the Event Date
CANCELLATIONS / POSTPONEMENT - In the event of a cancellation or postponement of the Event Date for any reason, by either party the Rental Fee is 100% transferable to the same value to any date 24 months in advance, as availability prevails at elizabeth’s at the time of application. No refunds of the Rental Fees will be paid.
LICENSED HOURS – 6.00am - 3.00am daily. Last drinks will be called at 2.30am and all guests must vacate the premise by 3.00am.
CAPACITY – 140 pax, standing. 100 seated
OBSERVANCE OF BOOKING PERIOD - The Hirer must observe the Booking Period and arrive and leave on or before the agreed time.
SMOKING – Smoking of tobacco is permitted in the outdoor area only. Smoking of vaping products are permitted inside.
USE OF FACILITY - The Hirer and guests shall behave in an orderly manner and fully compliant with applicable laws. The Hirer is responsible for their guests. elizabeth’s reserves the right to remove any person from the premises who have or are likely to cause injury, damage or behave inappropriately at their sole discretion.
CARE OF PREMISE - The premises and facilities must be left in a reasonably clean and tidy condition. The Hirer will be responsible for any expense in connection with repairs, damage, breakages or loss of equipment, including all AV equipment. Any repairs should be based on quoted costs for repair. Inappropriate use of the fire safety equipment resulting in any liability or loss to elizabeth’s will be passed onto the Hirer for reimbursement made by way or deduction to the bond.
HOST RESPONSIBILITY POLICY – A responsible service of alcohol policy applies at all times. No persons under the age of 18 years shall be served with or allowed to consume alcoholic liquor. No alcohol is to be consumed outside the premises. The Hirer shall be responsible for the good conduct of their guests. elizabeth’s reserve the right to ask any guest to leave if they feel that they are overly intoxicated or abusive.
INSURANCE – LIABILITY - The Hirer agrees to indemnify, defend, and hold elizabeth’s, its landlord, building owners, officers, employees, and agents harmless of and from any liabilities, costs, penalties, or expenses arising out of and/or resulting from the rental and use of the premises.
CONDUCT - elizabeth’s has a zero drug use policy. Disparaging remarks or any type of physical violence will not be tolerated and will be cause for immediate expulsion. The Hirer and guests shall use the premises in a considerate manner at all times. The Hirer and guests are not permitted to take into or use the following substances, without the prior written consent of elizabeth’s within the venue and grounds: Fireworks or flammable substances, Chemicals deemed toxic or dangerous, Prohibitive substances. Conduct deemed disorderly at the sole discretion of elizabeth’s management shall be grounds for immediate expulsion from the premises and conclusion of the rental period. In such cases no refund of the event costs shall be made.
CATERING STANDARDS - Insurance — all caterers working at elizabeth’s are required to have a valid certificate of Liability insurance on file. Kitchen Policy — The kitchen will be provided in a clean condition and the space should be returned to a clean condition immediately following your event. A final inspection will be conducted by the Hirer and elizabeth’s at the close of your event. Caterers must remove all trash, composting and recyclables from the site and dispose in the waste bins provided.
MUSIC & NOISE - elizabeth’s is available to host any form of entertainment including DJ or Band. Volume levels are at the discretion of the management. Music and noise are to be restricted to a reasonable level. All music and noise music cease by 2.30am. The level of noise emission shall not exceed acceptable council levels when measured at the nearest boundary of any residential property or by elizabeth’s and/or security staff. If repeated disturbances are created, at the discretion of elizabeth’s the Hirer may be expelled from the premises or the offending noise will be ended. In the event of disturbances to the point of expulsion, no portion of the event costs will be refunded to Hirer.
PROPERTY - LOST AND FOUND - elizabeth’s takes no responsibility for personal effects and possessions left on premises during or after any event. However, every attempt will be made to return any recovered item to its rightful owner. All items of property owned by the Hirer and their guests must be removed from the venue by the agreed pack-out time. The Hirer is not permitted to remove elizabeth’s property without written consent. Furniture may be moved to other areas inside venue if pre-arranged.
LOAD-IN/LOAD-OUT AND STORAGE - Load-ins and load-outs must take place within Booking period. If there is an event prior to yours a timed delivery will be required. elizabeth’s is not responsible for checking in or handling any items brought into the venue. Deliveries and collections are permitted between the hours as defined within your booking period.
DECORATIONS - Fixing points are located throughout the venue. Any additional fixings must be approved by elizabeth’s. All decorations and their fixings must be removed afterwards. The Hirer should have the proper insurance cover. elizabeth’s make every event a special and welcome experience. Therefore every effort will be made to allow the Hirer to prepare decorations reflecting their creative requirements. We ask that only the staff of elizabeth’s rearrange and move any furnishings, including, but not limited to, artwork, lamps, antiques or seating. Any damage will be charged after your event.
CANDLES & NAKED FLAMES must be contained in approved and appropriate candle-holders or glass votive to prevent wax spills and must meet NZ Health and Safety regulations.
SAFETY - Fire exits must remain clear of obstructions. Due care must be taken by the Hirer and guests. Children are to be supervised at all times.
ANIMALS - No pets or animals are allowed in the premises without prior written permission from elizabeth’s.
BREACH OF CONTRACT – elizabeth’s reserves the right at their sole discretion not to approve any application or to cancel the agreement at any time for any breach of policy or procedure. Failure to comply with the requirements of this policy will be regarded as a breach of agreement, giving the venue the right to cancel or pursue for recovery of any amount due.
ENTRY AND EXIT - The Hirer agrees that elizabeth’s staff may enter and exit premises during the course of the event. A representative of elizabeth’s may be on site during your event and will be checking periodically with the responsible parties to ensure everything is running smoothly. It is the responsibility of the Hirer and their contractors or employees to ensure that all practical measures are taken in running the event smoothly.
SECURITY - elizabeth’s is under 24-hour CCTV surveillance.
LAW - The Hirer agrees to comply with all applicable Local & National laws and shall conduct no illegal act on the premises. The Hirer agrees, for everyone’s safety, to ensure alcoholic beverages are consumed in a responsible manner. elizabeth’s reserves the right, in its exclusive discretion, to expel anyone who in its judgment is intoxicated or under the influence of alcohol or drugs, or who shall in any manner do or participate in any act jeopardising the rights, use permit, or insurability of elizabeth’s or the safety of its staff, guests, or building contents.
PROMOTIONS AND COPYRIGHT - Professional imagery of elizabeth’s can be provided for your use in promotional purposes surrounding the event.
HEALTH AND SAFETY - The Hirer will be aware of, and comply with, any relevant obligations imposed on them under the Health and Safety at Work Act 2015 (the “Act”). elizabeth’s will not assume any duty imposed on the Hirer from time to time pursuant to the Act arising out of this engagement.
As the Hirer of Elizabeth’s you must abide by all in-house Health & Safety requirements, policies and procedures. Any deliberate act that causes harm to an employee or guest may incur fines under the Health & Safety at Work Act 2015.
